·        VOLUME on behalf of Super Magnificent Coffee Company Ireland (“we” or “us” or “our”) is managing and operating the website in and its other digital platforms (website and other digital platforms are collectively referred to as “Platform”). Your privacy is very important to us. This Privacy Policy applies to all current and former users accessing or using our Platform, or otherwise engaging with us through email or other means (collectively, “user” or “users” or “you” or “your”).

·        This Privacy Policy describes the types of information including personal information (personal information is referred to as “Personal Information”) we collect from you through Platform. It also describes the purposes for which we collect such information including Personal Information, the other parties with whom we may share the same and the measures we take to protect the security of your Personal Information. It also tells you about your rights and choices with respect to your Personal Information, and how you can contact us about our privacy practices. Please also note that presently we do not collect any sensitive personal data or information (as defined under the present Indian legal regime. However, we may in future collect the same and shall update this Privacy Policy accordingly.

If you connect with us through any of these services, then such engagement will be subject to the terms of service and privacy policy of the relevant social media platform and you should review the same before connecting with us on such social media platform.

·        Our processing of your Personal Information in the context of your use of our Platform are based on our legitimate interests to operate an internet website for general information and communication purposes, to optimize our website, and to protect it from attacks.

 

4.        CONSENT

·        We understand that all Personal Information being provided by you to us is voluntarily and unconditionally. ·        Service providers/consultants etc: Disclosing your information (including Personal Information) to companies and individuals who are authorised by us to perform certain functions in relation to the Platform and/or our business, including our third-party service providers, consultants and professional advisors and insurers. For example, we use the platform provided by Shopify to us for managing and operating the website. ·        Affiliates and Franchisees: Such information (including Personal Information) may be accessed by or shared with our group companies, subsidiaries, affiliates and franchisees whose use and disclosure of your information (including Personal Information) is subject to this Privacy Policy.

·        Business transfers: We may disclose or transfer all your information (including Personal Information), as part of any merger, sale, and transfer of our assets, acquisition or restructuring of all or part of our business, bankruptcy, or similar event.

·        Others: Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. 7.        RETENTION

·        We retain your Personal Information and data for as long as it is required to fulfil the Purposes outlined in this Privacy Policy and for legal or regulatory reasons. All users can request to edit, or delete their Personal Information at any time as outlined in Clause 11 (Changes To Your Information). We will entertain your request for deletion of any Personal Information and data, however, there is a strong possibility that copies thereof will be retained indefinitely in our systems, including in cached and archived pages of the Platform. In addition, due to the nature of the internet, copies of your private communication, including the emails or texts that you have removed or deleted, may also exist elsewhere on the internet and be retained indefinitely.

We are not responsible for any such Third-Party Services content, any use of these Third-Party Services, or the privacy practices of these Third-Party Services. Further, we are not liable for any loss or damage which may be incurred by you as a result of the collection and/or disclosure of your information (including Personal Information) via Third-Party Services. We shall not be liable for any disputes arising from or in connection with such transactions between you and the aforementioned third parties.

 

9.        COOKIES, PIXEL TAGS AND SIMILAR TECHNOLOGIES

10.   AMENDMENTS TO THIS PRIVACY POLICY

·        We may amend this Privacy Policy at any time, in our sole discretion. We shall not be under the obligation to separately or personally notify you,  of any changes made to this Privacy Policy. Your use of the Platform is subject to the most current version of the Privacy Policy made available on the Platform at the time of such use. You are requested to regularly visit the Platform to view the most current Privacy Policy. Your failure to cease use of the Platform, after the amendment, will constitute your acceptance of the amended terms. If you do not agree to the amendments or to any of the terms in this Privacy Policy, your only remedy is to cease use of the Platform.

 

11.   CHANGES TO YOUR INFORMATION

·        You may review, correct, update, or change your Personal Information on the Platform by emailing us at marketing_india@coffeebean.com .

·        You may also request us to delete your Personal Information, and we will comply with such requests within a reasonable time, to the extent possible or unless we are required to keep certain information for legal purposes.

·        Should you choose to delete your Personal Information, or modify it in a way that is not verifiable by us, or leads to such Personal Information being incorrect, we will be unable to provide you with access to our Platform, and such a deletion or modification may be regarded as the user seeking to discontinue access to our Platform.

·        Access to, or correction, updating or deletion of your Information (including Personal Information) may be denied or limited by us if it would violate another person’s rights and/or is not otherwise permitted by applicable law.

 

12.   DISCLAIMER

·        We cannot ensure that all of your information including Personal Information will never be disclosed in ways not otherwise described in this Privacy Policy. Therefore, although we are committed to protecting your privacy, we do not promise, and you should not expect, that your information or private communications will always remain private. As a user of the Platform, you assume all responsibility and risk for your use of the Platform, the internet generally, and the information you provide to us and for your conduct on and off­ the Platform.

 

13.   INDEMNITY

·        You agree and undertake to indemnify us in any suit or dispute by any third party arising out of disclosure of information by you to third parties either through our Platform or otherwise, and your use and access of websites, applications and resources of third parties. We assume no liability for any actions of third parties with regard to your information or Personal Information which you may have disclosed to such third parties.

 

14.   SEVERABILITY

·        If any court or competent authority finds that any provision of this Privacy Policy (or part of any provision) is invalid, illegal, or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this Privacy Policy will not be affected.
